Terms & Conditions of Sale

TERMS OF SALE:  NO CREDIT TO ANYONE! ALL PLANTS MUST BE PAID FOR WITH CASH UPON DELIVERY to your nursery or when you pick up your plants at our nursery.  A $25 FEE WILL APPLY TO ALL RETURNED CHECKS!

**ANY ACCOUNTS WHICH HAVE ESTABLISHED CREDIT PRIOR TO OUR NO CREDIT POLICY EFFECTIVE DATE OF 1/1/08 WILL BE CHARGED THE FOLLOWING LATE FEES ON INVOICES NOT PAID WITHIN 30 DAYS.

LATE FEES INCLUDE:  Late fees in the amount of 18% APR (1.5% monthly) on all amounts over 30 days as well as any and all charges associated with the collection of this debt by parties other than Jones Gap Tree Farm and its employees, including but not limited to Jones Gap Tree Farms attorney fees, court costs and filing fees.  This policy is effective on all invoices not paid at the time of delivery or pick up.  If a payment arrangement is made, late fees in the amount of the 18% APR (1.5% monthly) may be waived at the discretion of Jones Gap Tree Farm based on the buyer’s credit history and the payment arrangement, this DOES NOT affect our ability to collect late fees  associated with the collection of a debt as part of our late fees policy which will not be waived. If the buyer defaults on a payment arrangement in which late fees (as stated above) were waived all late fees shall be retroactive at the stated rates on all amounts still owed.  Buyer agrees to these terms & conditions upon acceptance of merchandise and by signing of invoice either by buyer or buyer’s agent.

LIABILITY:  Liability ceases upon delivery to your truck or trucking company except when delivery is made by us, then liability ceases upon delivery to customer.

CLAIMS:  All claims must be made within 48 hours of receipt of shipment.  No other claims will be considered.

DELIVERY:  We prefer for your truck to pick up plants at our nursery.  When plants are delivered by us, an additional charge of $4 per mile one-way will be charged.  Our trucks will only deliver within a 200 mile radius.  We will call when your order is ready.  Orders not picked up within 3 days of specified time will be considered cancelled.  If you need directions, please call us.  CUSTOMER IS RESPONSIBLE FOR UNLOADING TRUCKS.

GUARANTEE:  All sales are made with the understanding that we shall not be responsible for shortages or problems due to crop losses, labor or weather beyond our control.  The only guarantee being that plants are true to name and upon proper proof, we will replace the plants or refund your money.  At no time are we liable for more than the original purchase price.  WE DO NOT GUARANTEE THE LIVABILITY OF ANY PLANT, NOR DO WE GUARANTEE ANY PLANT TO BE SUITABLE FOR ANY JOB OR GIVEN PURPOSE.

NOTE TO CUSTOMERS: WHEN YOU PLACE YOUR ORDER PLEASE USE THE COMMON NAMES TO HELP AVOID CONFUSION.  

**THESE TERMS & CONDITIONS SUPERSEDE ANY PREVIOUS TERMS & CONDITIONS WHETHER ON OUR WEBSITE, BROCHURES, EMAILS OR INVOICES**
